Privacy Policy
We have created this privacy statement in
order to demonstrate our firm commitment to
your privacy. TinyTIMBERS does not share,
rent or sell any information collected on
this site with any other party. The
following discloses our information
gathering and dissemination practices for
this website. We will use the information
you give us, such as your name, address and
e-mail address, internally to send you the requested
information. We will also add you to an internally
maintained appropriate mailing list from which
we may fax/e-mail or direct mail you information
in the future about us and
our products. You
may opt-out of these mailings at any time and
we provide that option in each mailing to you.
Pricing & Availability
We have made every attempt
to provide current pricing. However, prices
are subject to change without notice. We will
provide availability and price confirmation
with each order.
Due to the diverse nature
of our products, grades and species, our products
are subject to availability. Our mill generally
runs on a 30 day production schedule, although
many items are available from inventory for
shipping within 2 weeks. Please contact us to
confirm stock and current lead-times.
Damaged or Incomplete Shipments
It is important for you
to inspect your order upon receipt. You must
determine if the material meets your expectations
PRIOR to finishing/installation. The installer/end-user
assumes all responsibility for final inspection
as to grade and manufacture.
You must notify us of any
damages, incomplete or incorrect shipments within
5-business days of receipt. We will correct
any deficiencies as soon as possible and to
your complete satisfaction.
Returns
Returns are limited to
stock material only that has been purchased
within the past thirty (30) days. Materials
accepted for return (excepting errors that we
have made) must have prior authorization, be
returned at buyers expense and may be subject
to a 20% restocking charge. Cash refunds are
not permitted. Replacement stock will be provided
or in-house credit will be issued.
Items noted as "custom", timbers,
posts and beams, tooling costs, pre-hung doors,
jambs, stair components, materials specified
to non-standard sizes, modified in any way or
reflecting job site or handling neglect are
not returnable.
Delivery & Storage Fees
Unless stated otherwise,
all products are sold FOB our mill in Deputy,
IN 47230. Onsite delivery is available and quoted
on request. Please click

Since our operations are
“tiny”, space is a valuable commodity. We must
insist on timely delivery/pickup of your order
and & settlement of your account. You must make
prior arrangements for storage of your finished
product. We reserve the right to assess a storage
fee equal to 5% of invoice total for material
not claimed within 14 days of completion. In
addition, warehouse storage fees of $5.00 per
day will be assessed from the 15th thru the
60th day. Materials not claimed within 60 days
of completion will be considered abandoned and
all materials and payments on account will be
forfeited.
Payment Terms
A 20% deposit is required with your order. An additional deposit
may be required on custom orders. We will confirm deposit requirements
upon order placement. The full remaining balance is due upon order completion or
delivery acceptance. For common carrier shipments, payment is due
upon order completion and prior to shipment.
For your convenience, we accept American Express, Discover Card, Master Card and Visa. Due to
the diverse nature of our products and for security purposes until our
ecommerce store is available, your credit card payments should be made as

Late Fees and Returned Checks
Accounts not paid in full within terms will
be assessed a late fee of 1.5% per month (18%
A.P.R.) plus a $5 minimum per month billing
charge on all past due accounts - plus the cost
of collections (including but not limited to
reasonable attorney’s fees). Checks returned
for insufficient funds shall be assessed a $30
return check fee.
Limited Warranty Overview
TinyTIMBERS warrants that
our products, as shipped in their original manufactured
state to meet or exceed accepted industry standards,
as further defined:
-
Free from defects in materials and workmanship
when it leaves our possession.
-
Of the grade written on our invoice and
defined in our product description and specifications.
-
Unless stated as unseasoned, green or air
dried, our products shall be kiln dried
to 8% moisture content, plus or minus one
percent, when it leaves our possession.
-
Standard industry trade practices allow
up to 5% of a solid wood flooring, paneling
or siding product shipped to contain milling,
handling, finish and/or grade defects. This
warranty applies only to that material in
excess of 5% that is deemed to be defective.
-
Since each product we manufacture is unique,
the yield for each run will vary. We therefore,
reserve the right to ship up to 5% over
your requested footage. On specified lengths,
we reserve the right to substitute the next
longest available stock length when necessary.
In both instances, you will be invoiced
for the actual footage shipped.
-
TinyTIMBERS will, at its option, either
act expeditiously to replace or refund the
purchase price of any item found to be defective,
prior to installation, in excess of the
5% of miss-milled/miss-graded product allowed
to be included under these Standard Industry
Trade Practices.
-
Hardwoods are not recommended
or warranted for exterior use. Wood may
naturally experience expansion and contraction
with environmental variances in humidity
and temperature. This is a normal process
that may manifest itself as dimensional
shrinkage, expansion or distortion such
as cupping and crowning and is excluded
from warranty claims initiating after delivery
acceptance.

TinyTIMBERS will, at its option, either
replace or refund, upon return to TinyTIMBERS,
the purchase price of any uninstalled product
found to be at a higher moisture content,
than represented, provided a higher moisture
content is not the result of moisture picked
up after the product leaves TinyTIMBERS
possession. Note:
It is the installer’s responsibility to
check the wood product’s moisture content
first and deem it acceptable for the site
as is or to equalize it prior to installation
- as TinyTIMBERS does not assume responsibility
for post-installation movement-in-service
issues. The installer must also inspect
the wood product as it is installed and
set aside or crosscut out defects found
prior to installation. Once the product
has been installed, the installer has deemed
the product acceptable. TinyTIMBERS assumes
no further responsibility for defects visible
at the time of installation, but installed
anyway or moisture that causes subsequent
movement, which has been installed anyway.

Naturally occurring
color, grain or character marks allowable
within our stated grading standards are
not considered defects. Please read and
fully understand the grading standards prior
to placing your order. Please feel free
to request product samples or visit our
showroom.

Tiny TIMBERS is not
responsible for any consequential or value
added processes such as sanding, prefinishing,
installations, assembly, or cutting materials
to length or any other associated costs.
Sole remedy hereunder is limited to product
repair or replacement not to exceed the
dollar value of the original purchase. No
other warranty is expressed or implied.
Solid Wood Flooring
Warranty Checklist & Installer’s Responsibilities:
It is the installer’s responsibility to follow
TinyTIMBERS Un-finished Solid Wood Flooring Installation Instructions, which include complete
instructions, in much greater detail than outlined
below, on the following topics:
Inspect the flooring upon arrival to ensure:
-
You received the quantity, species, grade
and size flooring you ordered.
-
There was not any handling damage or water
damage in transit (in which case you
need to lodge a claim with the transport
carrier – Call TinyTIMBERS, who can assist
you with this)
-
Prepare an installation plan, based on testing,
at the flooring site, of both the subfloor
for acceptable moisture content and the
site atmosphere for the proper range of
relative humidity. The installer must keep
a record, which lists the results of all
the tests taken.
-
Make sure the flooring received meets the
buyer’s expectations prior to installation
and they approve such issues as: The color/grain range and the color change
to be expected in the specie chosen and
how the freshly installed floor may vary
in look from the aged samples from which
their
selection was made.
-
Establish that the site and sub floor are
suitable for the installation method chosen
and
advise the buyer of, and correct any deficiencies
prior to commencing installation.
-
Install the flooring properly. This includes: Use of the proper moisture barrier/underlayment, mastic,
glue, or nails/staples. Equalize solid wood flooring in advance of installation
to match the equilibrium moisture content of the site to avoid subsequent movement.
-
Perform adequate color/grain selecting as
you install the floor, so as to not install
“odd
colored/grained” pieces in conspicuous places.
-
Protect the flooring and the finish during
installation and protect the flooring afterwards
from construction and move-in foot traffic
to minimize scratching and wear.
-
Instruct the end user in proper floor &
maintenance care as well as the need to
maintain proper
relative humidity levels at the site. Please
see TinyTIMBERS
Maintenance Instructions.
There are no post-installation warranties with
solid wood flooring as:
Our pre-installation
warranty covers all visible defects, which should not be installed, and are
warranted against. Provided you have followed
TinyTIMBERS Installation Instructions, you would have taken the following
steps, (plus all the additional recommendations
from our Installation Instructions). Following
these recommendations would eliminate most,
if not all, post-installation issues with un-finished
solid wood flooring:
-
properly equalized the moisture content
of the solid wood product, prior to installation,
to the installation site’s equilibrium moisture
content point in order to avoid post-installation
shrinkage/swelling/cupping issues..
-
Inspected the subfloor prior to installation
to make sure it is sound, level and dry
enough to accept solid wood flooring and
not cause subsequent post-installation shrinkage/swelling/cupping
issues.
-
Tested large enough samples, (before installation),
with the finish you propose to use in order
to make sure the finish is compatible with
the wood and also allow the end user the
opportunity to approve the look of the proposed
finish on test samples before you commence
finishing the product itself.
Exclusions under this Limited Warranty - including but is not limited
to:
-
Claims made on installed products with visible
defects as it is the installers responsibility
to set aside pieces with visible defects
and not use them. Products, once installed,
are deemed accepted.
-
Claims made on wood products installed with
excessive color/grain variation as it was
the installers responsibility to inspect
the wood prior to installation and install
the wood in a random and harmonious mix.
-
Color changes in the wood as it ages or
from exposure to sunlight.
-
Variation in the color/graining of the installed
wood product from showroom samples, as the
samples most likely will have aged and changed
in color, gaining the patina of a partially
or fully aged wood.
-
Improper preparation or excessive moisture
content of the surface on which this product
is installed.
-
Swelling, cupping or distortion in flooring
caused by an increase of moisture content
in the wood from moisture sources below
the floor such as a wet sub-floor, or from
moisture from above from such sources as
spills, excessive wet mopping, pets, etc.
-
Insect infestation if it occurs subsequent
to the date on which the product leaves
our control.
-
Improper shipping, handling and/or storage
after the product leaves TinyTIMBERS possession.
-
Excessive moisture from natural disasters
such as flooding, broken pipes, etc., in
which case your homeowner insurance company
should be contacted.
-
Improper flooring installation whereby our
Flooring
Installation Instructions are not followed.
-
Improper application/use including installation
over radiant heat which is not covered under
TinyTIMBERS Warranty.
-
Abuse /abnormal wear including, pet scratches,
indenting from “high heels”, dropped or
dragged
heavy objects, improper maintenance, failure
to protect entry & high wear areas with
mats, etc. as reviewed in
Maintenance
Instructions.
-
Any subsequent site refinish compatibility/panelization
issues, as this is the site installer or
refinisher’s responsibility to:
1) adequately test the finish they propose
to use for proper adhesion bond and, 2) to get approved by the end user, the
look of the finish they propose to use prior
to actually re-finishing the floor.
TinyTIMBERS Warranty – “the fine print”:
TinyTIMBERS neither assumes nor authorizes any
other person to assume for it any other obligation
in connection with the sale of this product.
This writing is the complete and exclusive statement
of the warranty, and is in lieu of all other
express and/or statutory warranties. Any implied
warranties, including, but not limited to the
implied warranties, merchantability and fitness
for a particular purpose are limited in duration
to the duration of this express warranty. Some
states do not allow limitations on how an implied
warranty lasts, so the above limitation may
not apply to you.
TinyTIMBERS obligation under this warranty shall
be limited to, at its options, providing replacement
of shortages, exchange of defective products,
or refund of purchase price for flooring with
visible defects returned to TinyTIMBERS prior
to installation. TinyTIMBERS assumes no liability
for incidental or consequential damages.
However, some states do not allow the exclusion
or limitation of incidental or consequential
damages, so this exclusion may not apply to
you. The sole purpose of the remedy provided
herein is the replacement/repair of defective
products or refund of purchase price. This remedy
shall be the buyer’s exclusive remedy, and shall
not be deemed to have failed of its essential
purpose so long as TinyTIMBERS is willing to
replace/repair such defective goods or refund
the purchase price.
This warranty does not apply to any product
or products designated as seconds, special or
nonstandard items. Any product or products so
designated are sold “as is”. In order to obtain
performance of these warranty obligations, the
person seeking performance should contact

This limited warranty gives you specific legal
rights, and you may also have other rights,
which vary, from state to state. Interpretations
- this sale shall be governed solely by the
terms and conditions herein set forth which
shall prevail over any conflicting terms and
conditions of buyer, any statement in buyer’s
purchase order, notwithstanding. All prior writings,
representations or negotiations with respect
to the subject matter are deemed to be merged
herein. The failure of either party to enforce
any of the provisions of this agreement shall
not be construed as a waiver of such provision
or of the right of any party thereafter to enforce
each and every provision. The terms of this
agreement may not be extended, discharged, amended
or modified, in any way, except by a writing
signed by an authorized representative of each
party. This agreement shall be construed in
accordance with the law of the State of Indiana.
